In a civil Federal  case, parallel to one of our age based appeals, a Federal Court refused to hold MySpace liable after they were sued by a young girl's parents when she lied about her age on MySpace which led to her assault by a MySpace user.  See, In Re Doe v. MySpace.  The Court refused to financially reward bad actors and liars, even if a minor, especially when her own lies led to the harmful contact.

Since several suits relating to age have arisen in Courts around the country, MySpace no longer allows a minor to post an adult profile and alter it later on and vice versa. Also, "minors" cannot contact be contacted by any adults on MySpace.  However, this is not enough.  This does not protect our children who frequently socialize on the internet.  Hopefully someday soon our laws will require all internet social network sites, including MySpace, to verify their user's ages. ISP and social network sites like MySpace and Craigslist should be proactive and voluntarily remove children and ilegal activity ads from their sites, especially if they do not card their users in any effective manner.

Having handled several matters involving age based lawsuits, we strongly feel our legislators should create laws which mandates that the internet, like bars, card its users.  This is especially important when use of these internet sites might lead to meetings between children and adults, whether mistakenly or not.  Till then - internet users and parents BEWARE and also adult users seeking liasons via the net.

 

Some newer matters:

Criminal and review of criminal convictions and sentences, juvenile or adults.  Remember, it is the Government's burden to prove someone guilty beyond a reasonable doubt and not the accused's - to prove their innocence.


Personal injury and property damage matters, IL and NY, business and personal claims.  Remember - insurance companies are not always looking out for your best interests. So it is important that you speak to an experienced attorney early in a dispute or claim of any magnitude.


Business Litigation.  Recently, presented arguments in support of denying the applicability of the Moorman Doctrine in a construction dispute.  Questions such as this -  does the Moorman Doctrine protect a construction company from their own negligence, mistakes and torts committed while carrying out a construction project in IL?
 
Recently, a trial court denied construction companies' motions for summary judgment holding Moorman did not apply and allowing the case to proceed.
